The Joint Commission expects practitioners to consider the recommendations found in knowledge-based sources. These recommendations may come from professional medical societies and physician organizations, nursing and allied healthcare associations and policy-making bodies, and/or local organizations. Knowledge-based information helps to broaden the perspective of physicians and other caregivers, who have traditionally relied on personal experiences to define best practices. 12. Vicarious liability in medical malpractice is the doctrine of holding one person liable for the acts of another depending on the theories of agency and control. Respondeat Superior establishes the responsibility of an employer for the wrongful acts of its employees. The elements of responeat superior include: (1) medical malpractice by a health care provider; (2) an employment relationship between providers and the MCO, as opposed to an independent contractor relationship, and (3) providers acting within the scope of their employment. 13. Legislation is law which has been produce by a governing body in order to regulate, to authorise, to sanction, to grant, to declare or to restrict. In terms of events, legislation defines the governing legal principles outlining the responsibilities of even organisers and other stakeholders such as the local authority, to protect the safety of the public. Legislation can have many purposes: to regula te, authorize, provide (funds), and declare or to restrict. Legislations are important throughout any work environment and society as without them we are not protected from hazards and promoting safety in the workplace. Two of the most important pieces of health and safety across the UK are the Health and Safety at Work Act 1974 and the Management of Health and Safety at Work Regulations 1999. These set the standards that must be met to ensure the health and safety of all employees and others who may be affected by any work activity. Other legislations also exist to cover all work activities that carry risks such as Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 1995, Food Safety Act 1990, Care Minimum Standards 2003, Care Home Regulations 2001 and The Manual Handling Operations Regulations 1992. Policies are clear, simple statements of how your organisation intends to conduct its services, actions or business. They provide a set of guiding principles to help with decision making. Procedures describe how each policy will be put into action in your organisation. Each procedure should outline: Who will do: what steps they need to take: Which forms or documents to use. Procedures might just be a few bullet points or instructions. Sometimes they work well as forms, checklists, instructions or flowcharts. Policies and their accompanying procedures will vary between workplaces because they reflect the values, approaches and commitments of a specific organisation and its culture. But they share the same role in guiding your organisation. Health and safety at work act legislations influence in health and social care setting by making sure there are no risks and hazards which can cause the staff any harm. This is done by them making individuals in the hospital or nursing home need to be careful with the items they are working with. The hospital or care homes have to follow these guidelines and legislations because if they need to make sure the environment around them is safe and free from any danger that may cause harm to other patients. They have to follow rules which they have been assigned to such as make sure they always use hand sanitizer before dealing with patients and also keeping all the waste away from patients and disposed properly. They promote safety around hospitals or nursing home by having posters around the place promoting safety such as everyone should use hand sanitizer before they enter the hospital or signs such as having a sign up when they have just cleaned the floor, they use a wet floor sign. H ealth and safety at work act policies and procedures protect individuals because if they do not follow the rules then people will not feel safe around the hospital and feel as if they will be in danger. So following the rules would make people feel safe around the hospital, which will make sure that the patients are feeling safe around the hospital due to the security of premises which is good because it creates a safe place to be in. This promotes safety because if you have security in the premises then this means people can tell that there’s no danger in the hospital . The Health and Safety at Work act 1974 (also known as HSWA, HSW or HASAWA) is the prime piece of legislation in Great Britain. The Health and Safety executive enforces the act with other acts alongside it to make sure that a working environment is appropriate and safe to work in without causing any hazards that may affect a person’s health. It is the duty of any person that has control to said premises to make sure that the Health and Safety at Work act is followed and applied to the site. If anything is deemed unpractical or unsafe according to the Health and Safety at Work act whether it be substances, unstable furniture, storage, inadequate training of others and maintenance to the working in building and facilities, then measures must be taken to correct this issue. Any person should be able to enter the building  without risking their health or safety. The health and safety act would be enforced in the home by: †¢ Making sure furniture in the home is safe and sturdy and suitable for anyone to use without them being injured; †¢ Making sure that all wires are neat and not in open spaces or under a cable tidy where people are vulnerable to trip over them; †¢ Produce risk assessments within the home i.e. trips outside the home, events that are held within the home and general everyday procedures. In Dunstable Children’s Home, the person that is in charge of the premises, which would be a caretaker, is responsible of making sure that all furniture that is used by any employer, employee, service user or visitor, is safe and stable and that it will not cause any risks to their health. Also all substances that are deemed as dangerous to health must be locked away from the younger children because they may not know what they are doing due to them having learning disabilities.

Causes of the American Civil War The United States maintain their position of the world as the strongest, most influential country for many decades. Observing their history closely, we can see that they had gone through many ups and downs, and harsh yet necessary battles within the nation and with other countries. In order to examine the Civil War and reconstruction of the United States, we need to understand the causes of the war, what happened during the war, and the changes that the war had brought. I believe that the Civil War of 1861 played a significant role in building the stronger nation; likewise, I will discuss three major causes of the war – which are the slavery, the conflicts between the North and South states, and the Presidential election of 1860 – describe how dreadful the war was, and how the slavery, the relationship among the states, and the economic and political situation changed after the war. Moreover, I will present my own views on the Civil war. First, the slavery was one of t he greatest causes of the Civil War. The Slavery in all across North America has had existed for 168 years. Eventually, by 1804, most of the Northern states abolished slavery institution, but the invention of cotton gin in 1793 increased the use of slaves in the South and the slavery became very important for the South. Before the Civil War, the tension between the North and the South was invested in Slavery. The North was insisting that America should become free country and need to industrialize the South. On the other hand, the South was opposing the North by being pro-slavery for their agricultural industry. The U.S. Constitution was clearly permitting slavery even though the document did not include the words slaves and slavery. For example, in U.S. Constitution Section 2 of Article IV said â€Å"held to Service or Labor in one State, under the Laws thereof, escaping into another† (Constitution On Slavery). It shows the fugitive slaves must be returned to their owners. M oreover, the Bill of Rights in 1791 did not mention about slavery, yet on the Fifth Amendment, it says â€Å"Be deprived of life, liberty, or property, without due process of law† (Constitution On Slavery). According to the Fifth Amendment, the slaveholders were given an absolute right to take their property with them. Since the slaves were equaled properties, they could take their slaves even to the free Northern states. It developed into negative conflicts between the North and the South. However, America gained huge part of the West from the victory in the War with Mexico, including California, Utah Territory and New Mexico Territory. In Addition, the amount of gold that was discovered in California was huge and it led the Gold Rush in America, which did not last for long. The issue of whether the new states in the West should be opened to slavery or should be free from the slavery brought a big political confusion. The state of California was extremely important for the b oth powers. The North was asserting completely opposite opinions from that of the South. Since California got so much richer quickly, if the slavery in California got abolished, the South states would significantly lose their political and economic power. In contrast, if the slavery got permitted and protected by the federal government, the South states would be able to gain more power. Reflections of the Communist Manifesto and the Social Movement Essay For many, these ideals include national and social institutions, which make up the essence of their government allowing its citizens to identify with the status quo and maintain balance in their society. The question is not which institutions should be valued for most would agree that a proper balance of these make up any government; the main question lies in which institutions a society should value in order to achieve their goal, thus separating the school of thought pertaining to conservative and liberal thinkers. The simple and straightforward institution of a hierarchy comes into play when discussing the ideas of such thinkers. Maintaining a proper government is a delicate and complicated skill only acquired by the educated, rational men set out to implement it. Said skills â€Å"require a deep knowledge of human nature†¦ and of the things which facilitate or obstruct the various ends which are to be pursued by the mechanism of civil institutions† and is the civic duty of only certain members of society. If the government belonged to the State and was the sole property belonging to every individual within that State, there would never be a balance, for not every man is entitled nor has the necessary knowledge to carry out the needs of the State. In other words, not every man in society may acquire these skills in the same way considering some men will be naturally better and faster than others. Specializations do and must exist in society, some belonging to politicians and persons of State, others to farmers and shopkeepers, and others to scholars and true professionals. It is irrational to assume that one would resort to a professor of metaphysics with regards to food or medicine as opposed to a farmer or a physician1. Karl Marx rightfully entertained the idea, however, that the bourgeoisie eliminated industries and institutions (and will continue to do so), laid out by history hundreds of years before, and in doing so created an unstable and fragile ground for the birth of new institutions which would inevitably meet their doom under the control of the ever changing bourgeoisie revolution. In this respect, we should commend Marx, for his insight in the matter justifies the idea that the bourgeoisie revolution was performed rashly and ignorantly with complete disregard for the citizens (other than those pertaining to their own group) that would be affected. All the â€Å"fixed, fast-frozen relations, with their train of ancient and venerable prejudices and opinions are swept away, all new-formed ones become antiquated before they can ossify† and therefore will never maintain what is necessary to carry out a proper, balanced government. These barbaric groups of individuals only take into account their personal gain; they always seek and will seek the best way to take advantage of their political power. We must acknowledge that, as opposed to the godless society that socialism proposes under what seems like an imaginative state of mind, the bourgeoisie still maintain the stratification system that any society would be lost without. However, this system means very little without the hard-earned and well established institutions which lasted centuries, pleased millions and most importantly survived the test of time when even the greatest of men could not. With said institutions displaced, there are none to replace them for â€Å"no simple disposition or direction of power can be suitable either to man’s nature, or to the quality of his affairs† which makes the bourgeoisie unprepared and simply unfit to compose a brand new government to fill the hole left in current society. Marx justly shames the bourgeois State for not only eradicating long standing institutions. And I venture further in shaming them, for â€Å"our institutions can never be embodied†¦ so as to create in us love, veneration, admiration, or attachment†¦. [And] that sort of reason which banishes the ffections is incapable of filling their place†3. To think that a group of selfish, barbaric, rash individuals can enhance a government that was built on devotion and respect is a false assumption of all that is reasonable. Granted, Karl Marx would do away with all forms of stratification, but he still recognizes one of the greatest faults in th e current regime: the bourgeoisie â€Å"has reduced the family relation to a mere money relation†. It has converted our most sacred institution into a power- and production-gaining scheme where arrogance is encouraged and love for our country blatantly dejected. Marx firmly believed that the entirety of the working class was to unite and create a communal system in which every man is entitled the fruits of other men’s labor and vice-versa. This view includes the idea that all property is communal and that man has no country, meaning all major aspects of current economy should belong to the State. Hard working men fulfill their duty for all of society to benefit and no one particular man would be deemed to work better, faster, or for a higher wage than another man, in any form (through wages, property or social status). Simple measures must be implemented in order to win the battle of democracy which include, among others, the removal of all private property and the appropriation of all rents of land to the State, the â€Å"abolition of all rights of inheritance† and the centralization of the State, where all assets pertaining to individuals are to turnover to the government. Thus, property is the least of concerns for the citizen, allowing him to concentrate on providing for the State and continuing the honorable day’s work with shoulders free of the burden of property. Once this is achieved, the opportunity for one class to gain influence or to oppress another, is abolished and with it the concept of political power and class distinction. Such is the view of the communist thinker: a delusional and imagined society where all that is needed for its success is the simple division of all property and the encouragement of camaraderie between all working men. But a decent, well educated thinker would easily disprove this idiotic belief. Property is one of the best traditional institutions. It allows for diversity in classes where by nature, no one can or should be equal. One cannot deny that a man’s natural rights â€Å"exist in total independence† of government and therefore there is no need for its interference in the most sacred of rights: private property. This distinction, granted from birth is, in the views of a sane mind, â€Å"neither unnatural, nor unjust, nor impolitic†7. In simpler words, the right to private property provides, for the stabilization of the State as a whole, security for those entitled to family wealth. The family, one of the strongest and most important traditional institutions in present-day society, depends on â€Å"the power of perpetuating property [for it is]†¦ one of the most valuable and interesting circumstances belonging to it, and that which tends the most to the perpetuation of society itself†7. Without the appropriation of property to the rightful group, the institution composed of family and its values is dissolved. Any paradigm advocating the abolition of property and the removal of family values cannot act as the basis for a successful government. There must be a deprivation of the power to subdue the labor of others through the unequal distribution of products, they say, but â€Å"let [the] large proprietors be†¦the ballast in the vessel of the commonwealth† to allow for balance in society so men can understand the value of their work and the importance of their family. Revolutionaries of any breed, the bourgeois or the socialists, must learn that stomping their feet in protest will merely cause them pain against the cold, stone ground. That is to say, only a well educated, pious, well mannered people should and must control a government to guide and protect the ignorant minds of its subjects for â€Å"even in the mass and body as well as in the individuals, the inclinations of men should frequently be thwarted, their will controlled, and their passions brought into subjection†9. We simply cannot allow a group of uneducated, irrational men to control a government meant for an elite, highly educated and well mannered society. For this very reason, not only is the bourgeoisie unfit to rule society but also the socialist party must be prevented from assuming any sort of political influence on the State. The current state of affairs is an utter disgrace where inferior, mechanical and unlearned men have the fate their peers in their hands. If Marx’s socialists were to have their way, society will meet its doom much faster and under more shame than if any other form of barbaric, rashly driven group were in its place. The pride and essence of any government or institution relies on a well established, patient and fitting group of individuals for â€Å"it is [this] substance and mass of the body which constitutes its character, and must finally determine its direction†10. Marx’s socialists are merely workers, petty wage-laborers that rely on a week’s work for a day’s subsistence; the very same people that cloud the streets in filth, spread disease and would barely be able to make out the headline of a newspaper. To even slightly entertain the idea that such a group is equal or shares the same sensibilities and needs that accompany a respectable and cultured man throughout his day, is preposterous. And to venture further into saying that the work of every man, regardless of merit or education or natural social status, shall be uniformly divided amongst every participant and no one man shall acquire more or less than the man next to him, is an even more appalling idea than the latter. To substitute an ignorant bourgeois regime, â€Å"we shall have an association, in which the free development of each is the condition for free development of all† and where the stratification of class shall be abolished. Is this really the rational conclusion men have come to? Have we no faith or hope for the progress and rightful place of the well respected man in society? That in order for our world to succeed, we must work for the benefit of godless men who have no filial or patriotic attachment to any substance of value and who regard proper morals as a form of subjection? This so called proletariat class of unskilled or semiskilled workers will shortly meet its demise for even throughout the leadership of the great royal family, one could easily identify the greed and avarice in the eyes of the lower class and surely a concentrated group of these people with a shameless lack of education and culture will stray into the hands of said petty feelings once more if only given the opportunity. We cannot entrust and put forth our most sacred ideals and morals in the hands of those who know not what they are or what to do with them. Simply put, â€Å"by having a right to every thing, they [will] want every thing† and thus we can expect they will take from those who respectfully and naturally obtained their fortune, both material and otherwise. The irrational concept of socialism and the so called solution to the bourgeois problem is clearly and undoubtedly the offspring of uneducated and cold hearted thought. We cannot expect for such decisions to comply with the proper and just ideas behind a successful government and we certainly cannot accept those who wish to implement it under the pretence that we are all equal and should strive for a communal society. Class stratification maintains the balance and social order of the strongest of governments and institutions and should never be compromised to fulfill the greedy wants and arrogant needs of the uneducated, unfit and socially incompetent lower class. We must keep in mind that these people have no regard for our values, morals, property, attachments, or ideals. They want to take our land and our possessions, in the process destroying the essence of each of our families and the great institutions which they represent, and divide it equally amongst those of lower rank in order to claim, dominate and revoke the traditions which so peacefully maintained social order throughout history. These godless, soulless beings merely want to abolish all that our ancestors spent centuries to build and replace it with the irrational concept of socialism which will inevitably collapse and leave no trace or strand of hope for those of us remaining faithful to the suitable and just form of social standards. His name implies he is a "low man", an ordinary man, whose dreams and expectations have been shattered by the false values of society he has put his faith in. Behind the Arch is published by the English 300 class of 2001, including students Chris Allen, Alisa Dixson, Jennifer Durham, Shelley Katzer, Max Kenkel, Teri Kramer, Toby Malavong, and Courtney Weller. Many questions came up about the alcohol use among the BVU students and community. This book is a great source for BVU because it shows causes relating to its effects of drinking on and off campus. These students reflect on their past experiences and explain what incoming freshmen students may expect in a college setting. Also, upperclassmen share their experiences in this book explaining what to expect as the years pass. High school students always look forward to the college life and surroundings. Most cannot wait until they are free from their parents and free to do whatever they want. As incoming freshmen attend Buena Vista University, many are afraid of what to expect. Talking from my own personal experiences, college is coming easy to me so far. From talking with other students, life is tough for them. As I have talked to other students, the problem is not so much the school work, but it is the social life. Many are afraid of what to expect. Many feel drinking may solve their problems because it may help them associate with others easier. This is where the drinking problem on the BVU campus begins. Here at BVU, party nights usually fall on Wednesday, Friday, and Saturday nights. This is because the local bars such as Puff’s and Malarky’s have specials on drinking. The biggest night most students talk about is nickel pitchers, which falls on Wednesday nights. If a student is of legal age of 21, they are able to purchase as many pitchers of beer for only five cents apiece. I think this is where most of the problems start. Many students drink even before they go to the bar, then when they get to the bar, they consume so much alcohol to get drunk. Most people know a nickel pitcher is a great deal, which is why a huge percent of students go party on Wednesday nights.

The Matrix The Matrix is a science fiction movie about artificial intelligence computers replacing mankind. I believe that this movie is a common type of display from the media is common paranoia so that they can get a reaction from people and sell their story. In the case of The Matrix, the movie dazzles people with awesome special effects using modern computer technology, which I find ironic. I find it self-conflicting and hypocritical for the media to use modern computer technology for their own good to show people how bad technology is. Amy Bruckman and Howard Rheingold would probably find this movie interesting in that it disagrees and agrees with certain aspects about their beliefs about the use of computers. The Matrix specifically shows how advanced technology such as artificial intelligence (A.I.) may one day get out of the control of the people and become a dangerous enemy to mankind. It turns out that in the movie people believe that they are living normal lives in the 90's as common businessmen and families as we do today, when in reality the time is later in the 21st century and people are hooked up to machines in pods where they are merely interpreting electrical signals which tells them that the they are alive in the 90's. They call this set up The Matrix. The artificial intelligence machines put these people in these pods for their whole lives where they never use a muscle in their body; they only think that they are moving and living normal lives.The reason why the artificial intelligence machines put people into pods is because the sky is scorched and there is no source of electricity, so the A.I. units found an alternate source of energy: humans. The star of the Movie, Neo, is enlightened by one of ... ...ul people can benefit people. Personally, I don't believe that true artificial intelligence can ever be reached. I believe that a computer can be so advanced that it may appear to be thinking on it's own, but only because a man programmed it to think in such away. I don't think that a computer can teach itself common sense and the true ability to reason between right and wrong like humans can. Linda McMahon stepped down as CEO of the WWE, Inc. on September 16, 2009. Linda McMahon officially announced her candidacy to run for the United States Senate for Connecticut. During this time others in office put the WWE, Inc. in the spotlight for political tirades against Mrs. McMahon and her qualifications. The WWE headquarters is based out of Stamford, Connecticut and this is also where the McMahons live. On November 1, 2010, President Obama and his wife Michelle visited Stamford, Connecticut and Mrs.Obama paid a visit to the WWE headquarters. After the President left the WWE, Inc. was told they were under investigation for distributing merchandise near select polling locations. The Secretary of State for Connec ticut, Susan Bysiewcz, stated that if anyone turned out to the polls wearing any type of WWE merchandise, including a simple wrist band that the voters would be told to either remove it, cover it up or to go home and change and come back. The WWE, Inc. took this to federal court and won because there is no law on what attire a voter should wear to vote. (Time Magazine, November 2010).On November 8, 2010 Linda McMahon lost to Richard Blumenthal and says she feels that there was corruption in the way the polls were run. Linda McMahon contributed fifty million dollars to her own campaign in the senate race. Linda McMahon is not going to return to her position of CEO at WWE, Inc. but plans on running again for a political party in the future. With Linda not returning to WWE, Inc. this leaves Vince McMahon as the chairman and now the CEO of WWE, Inc. The community that surrounds WWE, Inc. stands behind the WWE for the majority being that the McMahons contributes too many charitable facto rs in the community.With the President and his wife visiting Stamford it opened up many economical doors in the community promoting tourism and the trickle effects from the tourism and notoriety of the situation. No matter what changes the United States goes through in our economy WWE, Inc. still sells out every wrestling venue and almost all merchandise with their logo on it is a top seller and carries high demand for the public. Vince McMahon has received deals with people like Walt Disney to lease his wrestlers, like Duane â€Å"The Rock† Johnson, to star in their movies.Billions of people worldwide have an avid and loyal following of the WWE. The WWE has reached many countries outside the United States through television airing and internet access. WWE, Inc. has gotten the four factors of the marketing mix down to a science and the right marketing team behind them to do so effectively.The market researchers for WWE seem to be highly into utilizing environmental scanning as well. The marketing researchers have studied all the factors, such as global, technological, social cultural, and economic. WWE, Inc. really has no competitive factors to study at the moment, because there is no other competition right now; therefore, WWE dominates the industry. It seems everything that the WWE has its logo on is in mass market production throughout the world. The WWE may have started out as niche marketing but it quickly grew into a mass frenzy. The WWE logo and name brand is now worldwide.Vince McMahon and his marketing research team are genius. They have definitely done their market segmentations to a science and have even made merchandise availabl e for the poor to be able to purchase their products. The demographic segmentation is analyzed before the WWE even enters an agreement to bring their show to that arena. Everywhere they have a show it is a sellout every time. Vince McMahon was smart enough to hire tech and business savvy individuals to help ensure that he stayed on top of the game. Without his Vice Presidents in each area, this ompany would not have been able to overtake the wrestling market and branch out into every form of marketing, selling, technical areas, and merchandising that the WWE has done.
